Other worshippers were barred from entering the Juma mosque in Baku, which has been the target of a number of police raids in the past week. One report said police pulled back when the US ambassador arrived. Earlier this year, the authorities ordered the 1,000 year-old mosque to close. Its imam, Ilgar Ibrahimoglu is a leading human rights activist. The authorities say the Juma mosque community is occupying the building illegally, having failed to register with state religious bodies. But the mosque's leaders believe they are being targeted because Mr Ibrahimoglu is a government critic who was until recently the country's most prominent political prisoner. [Those arrested] came here not to attend prayers but for other purposes Police officer Speaking after Monday's arrests, Mr Ibrahimoglu told Turan news agency: "There is no freedom of conscience and belief in Azerbaijan to-" 'Concern' A police officer told AFP news agency that those arrested "came here not to attend prayers but for other purposes". The agency said police moved back when US ambassador Reno Harnish went to the mosque to sit in on the prayer ritual. Last week the US embassy in Baku said in a statement that it was following events at the mosque "with concern". Last Wednesday police stormed the mosque and expelled worshippers. A new imam backed by the authorities was appointed. A spokesman for the Azeri justice ministry, Hussein Alikhanov, said worshippers at the mosque were warned repeatedly to vacate the premises. The closure order followed the trial of Mr Ibrahimoglu, who was jailed for taking part in protests after a СПОРed presidential election last year that saw a landslide victory for the previous leader's son. But under pressure from the international community, Mr Ibrahimoglu received a suspended sentence.

Кроме этого Джума мечеть никогда и ни при каких обстоятельствах не держалась за руку Щейха или Америки или кого то не было. Кстати то что Гаджи Ильгар защищал как правозашитник права мусульман Ирака -очень не понравилось американцам.Но он правозашитник-он в свое время защишал и нардаранцев .А то что это случилось это- причиной этому последовательная зашита прав верующих женщин в хиджабе.И за долго до выборов еще буквально за полтора года этот процесс закрытия начался.Гаджи предлагали перестать зашишать права женщин на хиджаб -но он не согласился. Брат мой! Помоему ты мумин-просто не полная информация у тебя.Гаджи и несколько тысяч прихожан мечети Джума сами на свои силы всегда опирались и ни на кого не надеялись.Ни на Америку ,ни на Шейха и на других также. И еще невозможно удалить его и его команду-потому что он один из нас верующих прихожан мечети-а нас несколько тысяч. Smith (R-NJ) today expressed outrage over a Wednesday morning seizure by Azerbaijani authorities of the independent Juma Mosque in Baku, where police reportedly beat some worshipers before taking control of the place of worship. “The government’s forcible eviction of this peaceful Islamic community is an outrage,” said Chairman Smith, “no charges should be brought against the mosque's leadership.” The Juma Mosque community operated freely for nearly 10 years until its leader dared to speak out against the repressive policies of the Azerbaijani Government. “These Soviet-style tactics demonstrate the government is determined to control individuals’ religious beliefs and ignore internationally recognized standards of religious freedom, including OSCE commitments,” Chairman Smith observed. Agence France Presse reported Wednesday, “Worshippers said they were kicked and punched as police burst in during morning prayers at the Juma mosque in the capital, Baku, one of the country's few mosques to remain outside strict state control.” “These actions represent a serious breach in Azerbaijan’s human rights commitments and further tarnishes its international reputation,” said Chairman Smith. “Government violence against religious communities harkens back to the darker, Soviet days of Azerbaijan’s history. The government should allow for religious freedom and permit the Juma Mosque congregation to worship and operate free from government control.” Earlier this year, Baku city authorities successfully sued to oust the Juma Mosque community, reportedly claiming that the community lacked any rental agreement or government registration, and that the 1,000-year-old mosque was an historical site. Government authorities in 1992 returned the Juma Mosque – which during the Soviet period had been converted into a carpet museum – to this community, and registered it in 1992 and 1993. However, the State Committee for Work with Religious Associations has reportedly refused to re-register the mosque. Before the seizure, Azerbaijani authorities visited the mosque several times in June threatening closure of the worship site. Helsinki Commission Members denounced Azeri Government tactics in March as a “land grab dressed up as a legal proceeding.” Government actions have not been limited to the mosque. During the raid on Wednesday morning, police aided the unilateral installation of a new imam appointed by the Muslim Board of the Caucasus, a Soviet-era Muftiate close to the government, to replace the community’s leader, Imam Ilgar Ibrahimoglu. Authorities had jailed Imam Ibrahimoglu in December 2003 on charges related to his alleged connection to demonstrations following last October’s flawed presidential elections. He was released in early April after receiving a five-year suspended sentence. In addition to congressional actions, other governments and NGOs have often expressed concerned. In April, the Becket Fund for Religious Liberty filed an application with the European Court of Human Rights, noting that the Azerbaijani Government was threatening to use force to expel the Juma Mosque congregation “in retaliation for the pro-democracy, pro-human rights, and pro-religious freedom activities of its leadership.” The United States Helsinki Commission, an independent federal agency, by law monitors and encourages progress in implementing provisions of the Helsinki Accords. The congregates, who are mostly Shiite Muslims, are going to assemble at the mosque for their noon pray, said Najaf Allahverdiyev, brother of the mosque’s dissident Imam, Ilgar Ibrahimoglu. Police attempted early Wednesday to enforce a court ruling that considers eviction of members of the Juma mosque congregation from the mosque of the same name. The mosque goers and rights advocates say the court ruling, which was given in March, is an attempt to crack down on Ibrahimoglu for his pro-opposition leaning. Ibrahimoglu, who is also a known rights activist, was arrested in the aftermath of the last October’s post-election clashes in Baku. He was later release after receiving a suspended sentence. On Wednesday, Ibrahimoglu and his followers vowed to use all lawful and nonviolent means to remain in the mosque. They said they have already appealed to the European court.

The Shiite Muslim congregation of the Mosque managed to re-enter the building and do their afternoon pray together with their imam, Ilgar Ibrahimoglu. Several dozen congregants of the mosque remained in front of the building by the press time, waiting for another assault by police. Some 40-50 police officers broke into the building at around a quarter to 9 a.m., Seymur Rashidov, press officer of a local religious rights group, the Center to Protect Religious Rights (DEVAMM), told the Baku To- “They broke into the mosque after jumping over fences. Then they dragged me out of the building.” “I will stay and do my namaz (Islamic pray) here,” said the mosque’s imam, Ibrahimoglu who is also a known rights advocate, in a loud voice. Ibrahimoglu has received a suspended sentence after being kept in Baku’s Bayil jail for several months. He was accused of participating in 15-16 October post-presidential election riots that broke out in the Azeri capital. “If these believers want me to be their imam, this is their right.” Ibrahimoglu vowed to fight for the believers' religious rights “using all civil, non-violent and lawful methods.” Baku’s Sabayil District court ruled in early March to evict the Juma Mosque congregation members from the mosque by the same name, convicting them of illegal occupation of the building. But the Juma congregants said the court ruling was unfair and that it came as punishment for the activities of Ibrahimoglu. Although the congregants appealed the verdict, Azerbaijan's Appeals Court upheld the Sabayil court’s decision. Ibrahimoglu said he has already appealed to the European Court about the court ruling that demands Juma congregants to leave the mosque. The Juma mosque, built in the 15th century, was turned into a warehouse under Soviet rule in 1937 and then transformed into a tourist attraction as a carpet museum in the late 1960s. The mosque’s original status was restored only in 1992, after Azerbaijan gained independence from the former Soviet Union.

The mosque community has appealed to the European Court of Human Rights, following previous attacks on their religious freedom by the authorities. The entire Juma mosque complex in Baku's Old City, stormed and seized by police on 30 June (See F18News 30 June 2004 http://www.forum18.org/Archive.php?article_id=352), remains under police control, a member of the mosque community told Forum 18 News Service today (2 July). Najaf Allahverdiev, brother of the mosque's imam Ilgar Ibrahimoglu Allahverdiev, said that police are guarding the upstairs rooms and allowing in only supporters of Surkhai Mamedov, the imam imposed by the Caucasian Muslim Board, an organisation which the mosque does not belong to. He said the police had allowed the community into the main prayer hall at noon for midday prayers led by his brother, and that they had promised to let them in to evening prayers, but that the police said they would lock the mosque up after that. "They are refusing to let us in our own mosque for morning prayers." On telephoning the mosque office on 2 July, Forum 18 spoke to a man who identified himself as Haji Ilham, newly-named imam of the mosque, who said Imam Mamedov was not available. He said he himself had been named to the post by Sheikh-ul-Islam Allahshukur Pashazade, the head of the Caucasian Muslim Board. Asked what involvement the Board could have in a mosque that is not subject to its authority he responded: "That is not a subject for a telephone conversation." Pressed on the issue he insisted: "Who they are subject to is their affair. I am subject to the Muslim Board." Asked why the police were involved in installing leaders from the Muslim Board he responded: "That's not our affair." He said he was unable to say whose responsibility it was or who had invited the police to help in trying to install a new leadership. On 30 June, the mosque community rejected the attempt to install an imam against its will (See F18News 30 June 2004 http://www.forum18.org/Archive.php?article_id=352). Asked about his connection with the Juma mosque, Haji Ilham declared that he had long been involved at Baku's Taza-Pir mosque, where the Board has its headquarters. He claimed "sometimes" to have visited the Juma mosque for prayers in the past. He declined to answer any other questions and put the phone down. Allahverdiev told Forum 18 that the rooms inaccessible to the community include the mosque office, the room where the Koran is taught and the kitchen. "It was only because of the sheer numbers of people coming to worship – more than 2,000 – that they let us in to the toilet and washroom to conduct the ritual washing before prayers," he reported. "But they're not cleaning that area and with the large numbers of people it is now filthy." He said police officers in uniform with sidearms are guarding the entrance to the barred rooms and the police have put their own locks on the doors. Nuridin Mustafaev, the court executor for the Sabail district court, which ordered the community to vacate the mosque in March, a decision upheld by the appeal court in April, insisted that he was obliged to execute the court judgment. "We gave them a long time to leave voluntarily, but they didn't do so," he told Forum 18 disney on 2 July. "We were instructed to remove the community and their property and we did so." He admitted that "of course it was unpleasant" but denied there had been any political involvement in the decision to expel the community. Mustafaev said he knew nothing about any police violence and claimed the police did not enter the mosque's prayer room. He said that if any other court – including the European Court of Human Rights to which the mosque community has appealed – issues another ruling handing the mosque back to the community the court executors will hand it back. Mustafaev said he did not know who had invited the Caucasian Muslim Board to name new imams, but insisted that community members can still go to pray in the mosque, but simply can't use the other rooms. Allaverdiev reaffirmed that during the storming of the mosque on 30 June, the police officers had beaten the fifteen or so people they found inside with their hands. He said the police had been carrying sidearms in their holsters but had not used them. "They were very aggressive," he recalled. "Two policeman would hold someone while the third would beat them. It was very easy for them as we did not resist. We carried on praying." He claimed some of the officers involved in the raid had been drinking alcohol, which community members found highly offensive. He said the mosque community has heard rumours that the authorities are now preparing to close the mosque for "repairs". "The building doesn't need repairs," he insisted. "We have been looking after it well for the last decade." The authorities have also said in the past that they want to turn the 1,000-year old mosque into a carpet museum, which is what the anti-religious Soviet regime used it for. Среди таковых названо выселение религиозной общины "Джума" из одноименной мечети, преследование оппозиции и журналистов в Hахчыване, продолжающийся судебный процесс над оппозиционными лидерами. В послании судебное решение о выселении общины названо "крайне спорным", а действия полиции "незаконными". Община имеет законную регистрацию с 1993 года, а лидер общины Ильгар Ибрагимоглу лишь недавно вышел из тюрьмы по обвинениям в организации беспорядков октября 2003 года. Фонд "крайне озабочен" и событиями в Hахчыване, где полиция грубо подавляет права граждан на свободу выражений и собраний. Фонд обеспокоен также и ситуацией вокруг судебного процесса по делу оппозиционных лидеров, который воспринимается как политический, а основные права подсудимых не соблюдаются. В связи со всем вышесказанным, Фонд призывает власти Азербайджана создать условия для деятельности структур гражданского общества в стране, оградить от нападок правозащитников, восстановить права общины "Джума", проводить суд над оппозиционными лидерами в соответствии с международными стандартами.--0-- АПЕЛЛЯЦИОHHЫЙ СУД ОСТАВИЛ АКТИВИСТОВ ООК ЗА РЕШЕТКОЙ БАКУ/02.07.04/ТУРАH: Сегодня в Апелляционном суде было рассмотрено ходатайство адвоката Эльчина Гамбарова об изменении меры пресечения в отношении шести арестованных членов Организации освобождения Карабаха (ООК). Как сообщил ТУРАH зампред ООК Шамиль Мехти, суд оставил в силе меру пресечения, отказавшись ее изменить. Hапомним, что 22 июня были арестованы шестеро членов ООК, в том числе председатель Акиф Hагы и зампред Фируддин Мамедов. Hасиминский суд арестовал их на 2 месяца, против них было возбуждено уголовное дело по обвинению в хулиганстве, сопротивлении полиции и нарушении общественного порядка. В настоящее время арестованные находятся в Баиловском СИЗО. However, community members were allowed back into the mosque for afternoon prayers, before being expelled again. The police attack was observed by Ambassador Steinar Gil of the Royal Norwegian Embassy, as well as diplomats from the British and US embassies, as well as the OSCE. Ambassador Gil told Forum 18 that the Muslims "behaved very calmly and with restraint, doing nothing to provoke further violence", and other witnesses told Forum 18 News Service that the police beat some community members up. The authorities' attempt to impose their own imam on the mosque community failed. The current imam, Ilgar Ibrahimoglu, is strongly disliked by the authorities for his religious freedom and human rights campaigning for Christians and Muslims. In what members of the Juma mosque community describe as "a terrible day" and "a return to Soviet practice", dozens of police officers this morning (30 June) stormed their mosque in the Old City of the capital Baku, beat the members inside and forcibly evicted them from the building. Forum 18 News Service has learnt that after some 700 mosque members arrived in a show of support for their embattled imam Ilgar Ibrahimoglu Allahverdiev the police were forced to allow the members back in for the 2 pm prayers. Community members also refused to accept a new imam the Caucasian Muslim Board – to which the mosque is not subject – is trying to impose. "This was a terrorist action," human rights activist Eldar Zeynalov told Forum 18 disney on 30 June. "The community has challenged its court-ordered eviction at the European Court of Human Rights, so the government should wait for its judgment before taking any action. I see no urgent reason to expel the community now." Ibrahimoglu told Forum 18 the police arrived at about nine o'clock in the morning to "storm" the mosque. He said the police beat him, his brother Najaf and another activist Seymur Rashidov, as well as some 20 other members present at the time. Najaf Allahverdiev told Forum 18 some of those beating the mosque members were in civilian clothes. "They caused destruction, turning things over and taking Ilgar's computer," he reported. He said police then expelled all the mosque members from the building. As hundreds of the mosque's members gathered outside the building, diplomats from the Royal Norwegian, the United States and British embassies arrived, as well as an official of the Baku office of the Organisation for Security and Cooperation in Europe. Under pressure of numbers the police were forced to allow them in again. "I saw the police at about 9 am as I was arriving for work," Ambassador Steinar Gil of the nearby Royal Norwegian embassy told Forum 18 on 30 June. He said he had seen some forty policemen outside the mosque, with more inside he could not see. The police were armed with the usual sidearms and were without truncheons. "I didn't see any violence except a little pushing as the police drove the crowd back. Members of the community behaved very calmly and with restraint, doing nothing to provoke further violence." He said he had spoken to one mosque member who had told him he had been beaten, though without "excessive brutality". Ibrahimoglu told Forum 18 that the Caucasian Muslim Board's nominee to run the mosque, Imam Surkhai Mamedov, then arrived with a handful of supporters. "I allowed him to address the community, but the believers refused to support him as their imam. They were able to choose and chose me." He said Mamedov then left and prayers took place. He said about 4 pm the police came in again and ordered the community out again. "To avoid any incidents I told them to leave and to come back for evening prayers at 8 pm." The authorities have long disliked imam Ibrahimoglu and the mosque community, which insists on functioning independently of the Caucasian Muslim Board. The Sabail district court on 1 March ordered the community out of the 1000-year-old Juma mosque they regained for worship in 1992. The appeal court upheld the expulsion on 22 April. Court executor Nuridin Mustafaev told Forum 18 in April that expelling the Muslims from their mosque would be "unpleasant" but that he is obliged to carry out court orders (see F18News 26 April 2004 http://www.forum18.org/Archive.php?article_id=306 ). In a related case, Ibrahimoglu himself was only freed from prison on 2 April after being jailed and then given a five-year suspended sentence imposed in retaliation for his work as the mosque's imam and his religious freedom and human rights campaigning for Christians and Muslims (see F18News 5 April 2004 http://www.forum18.org/Archive.php?article_id=294 ). Court officials seeking to enforce the expulsion order interrupted Ibrahimoglu as he was leading prayers on 22 June. "Having entered God's temple without observing the necessary hygiene rituals, they came up to me in the presence of the believers during the prayer when I was reading the Holy Scripture, wanting to interrupt my prayer," Ibrahimoglu told Forum 18 on 25 June. "But I told the officers not to hinder me while I was performing the prayer in God's temple. If anyone wants to address me, he should wait till I finish." The officials then left. On 23 June the community sued those officials for interrupting the prayer. "The believers are indignant that the officials who entered God's temple did not observe the necessary hygiene rituals and by doing so insulted believers' religious feelings," Ibrahimoglu told Forum 18. He said they also sent a complaint to the Ministry of Justice about the "illegal" actions of their officials. Forum 18 could find no state official immediately prepared to discuss the storming of the mosque. Court executor Mustafaev was out on "work-related business", one of his colleagues told Forum 18 on 30 June. She declined to comment, saying that he was handling the Juma mosque case. Faiq Gurbanov, head of the human rights department of the Justice Ministry told Forum 18 on 30 June that he was at a meeting away disney and said he would have to find out about the raid. "I can't answer on this until I have checked up through my own sources." However, he stressed that court executors were required to enforce court orders. "This is not about freedom of religion, freedom of speech or freedom of assembly," he insisted. He dismissed reports of police violence. "The police would not get involved in that." He stressed that if the mosque members have any complaints they can take up the issue through the courts. Later, a spokesman for the justice ministry, Hussein Alikhanov, told the BBC that worshippers at the mosque were warned repeatedly to vacate the premises. "But they refused to do this... so this morning we carried out the decision of the court. There was no force and no violence used and we did not beat up any one." Ambassador Gil told Forum 18 he believes the authorities will have learnt from the response of the Juma mosque's members. "I think the authorities realise they should not go too far in preventing believers from attending prayers in their mosque and that trying to install a replacement imam against the wishes of the community was a failure." Zeynalov, who heads the Baku-based Human Rights Centre of Azerbaijan, believes the authorities are intent on sending a warning signal to Muslims who want to function independently. "The government would like to terrorise religious communities that don't want to be subject to the authority of the Caucasian Muslim Board." Ibrahimoglu said the community was upset that once again the police had come into the mosque without respect, storming in while wearing boots. He said that police officers repeatedly threatened that he would be arrested under the terms of his suspended sentence. Члены общины по-прежнему считают своим духовным наставником имам-джамаата мечети гаджи Ильгара Ибрагимоглу. О происшедшем 30 июня в мечети "Джума" инциденте мы подробно писали во вчерашнем номере нашей газеты. А теперь расскажем читателям о дальнейшем развитии событий. Со слов верующих нам стало известно, что со времени возобновления деятельности, а произошло это в 1992 году, мечеть "Джума" ни на одну минуту не закрывалась. В любое время суток любой верующий мог здесь совершить молебен - намаз. Ночь с 30 июня на 1 июля стала исключением из этого правила. Как рассказали нам прихожане мечети, поздно вечером полиция велела верующим покинуть мечеть, а затем заперла двери. Как известно, первый намаз совершается в пять утра. Так, пришедшие в мечеть на утренний молебен молодые люди застали "дом божий" запертым - охранявшая мечеть полиция, видимо, в это время еще спала. Позже двери мечети были открыты, и к девяти часам утра прихожане собрались на второй намаз. Однако верующие опять не пожелали собраться вокруг нового ахунда. По их словам, рядом с С.Мамедовым находились несколько человек, в то время как около 300 членов общины расположились в мечети отдельной группой. Такую же картину застали мы и во время дневного намаза, совершаемого в 14.00. И.Ибрагимоглу совершил вместе с верующими намаз, а затем начал читать проповедь. Находящиеся в мечети около 200 человек внимательно прислушивались к его словам. Новый же ахунд в окружении зампреда ДУМК гаджи Джебраила и еще нескольких представителей духовенства сидел у задней стены и совершал намаз. Среди них есть немало студентов вузов и сотрудников госучреждений и влиятельных деловых структур. Суть их речей сводилась к следующему: "Мы уже несколько лет являемся прихожанами этой мечети. Давно знаем Ильгара Ибрагимоглу. Его проповеди интересны для нас. С ним мы ведем беседы, касающиеся религии и других сфер. С Ильгаром Ибрагимоглу у нас установились хорошие отношения. Зачем нужно присылать сюда нового ахунда?". Кстати говоря, новый ахунд С.Мамедов не теряет надежд на установление контакта с общиной. Однако комментировать свое назначение он отказывается, считая, что данный вопрос следует адресовать руководству ДУМК. Вчера мы встретились с руководителем пресс-службы этой структуры гаджи Акифом. На просьбу высказать отношение руководства ДУМК к действиям полиции, ворвавшейся в мечеть и силой вытолкнувшей на улицу прихожан, он уклончиво заметил, что в таких ситуациях все должны быть выдержанными, не допуская насилия в какой бы то ни было форме. На взгляд гаджи Акифа, община мечети действовала незаконно, и руководство ДУМК решило навести там порядок. По его словам, ничего страшного в том, что община не воспринимает нового ахунда, нет. На взгляд гаджи Акифа, со временем все уладится. На наш вопрос - насколько соответствует закону назначение руководителя в религиозную общину, которая не прошла регистрацию в ДУМК, т.е. никоим образом не связана с этой структурой, гаджи Акиф заметил, что на это было соответствующее письмо Министерства юстиции. Кроме того, продолжил он, существует закон "О свободе вероисповедания" (принят он в августе 1992 года, изменения и дополнения внесены в 1996 и 1997 годах - М.М.), в соответствие со статьей 8-й которого в организационных вопросах все исламские религиозные общины подчиняются ДУМК. С другой стороны, заметил гаджи Акиф, статья 9-я упомянутого закона определяет ДУМК в качестве "исторического религиозного центра", объединяющего исламские религиозные общины. Для государственной регистрации общины должны обратиться с заявлением в "религиозный центр или управление". Потому, отметил гаджи Акиф, никаких противозаконных действий при назначении ахунда в мечеть "Джума" ДУМК не допустило. Свою оценку инциденту в мечети дал и гаджи Абдул Абдулов, бывший ахунд Мечети Имама Гусейна. Почему бывший? Дело в том, что в прошлом году гаджи Абдул подавал документы в ЦИК для того, чтобы получить регистрацию кандидата в президенты. Так как религиозным деятелям возбраняется участие в политической деятельности, то гаджи Абдул добровольно отказался от должности ахунда. Итак, по словам гаджи Абдула, азербайджанец, даже если он полицейский, не стал бы применять силу в отношении верующих прямо в мечети. Видимо, заметил гаджи Абдул, "применившие насилие люди были иной веры и иной национальности". В то же время он подчеркнул, что когда государству нужно решить какой-то вопрос, то оно с удовольствием опирается или ссылается на ислам, на религию. "А когда это не нужно, то государство заявляет, что религия отделена от него", - отметил гаджи Абдул. Относительно назначения нового ахунда он сказал, что испокон веков этот вопрос был прерогативой ДУМК. "Хорошо это или плохо - другой вопрос, однако с этим нужно смириться", - добавил гаджи Абдул. Он также нелестно отозвался о политической и религиозной деятельности И.Ибрагимоглу. По мнению гаджи Абдула, тот сильно заблуждается в обеих сферах. В то же время, гаджи Абдул считает С.Мамедова грамотным религиозным деятелем. Как видно, вокруг мечети сохраняется напряженная ситуация. Как нам стало известно, руководство ДУМК в ближайшее время намерено закрыть мечеть на ремонт. Таким образом, религиозное руководство намерено снизить накал страстей. Однако руководитель пресс-службы ДУМК гаджи Акиф сказал, что о закрытии мечети на ремонт впервые слышит от сотрудника "Зеркала". А в беседе с сотрудником "Туран" шейх Аллахшукюр Пашазаде отметил, что ахунд мечети "Джума" был назначен в связи с обращением Госкомитета по работе с религиозными структурами.
